Negative Balance Protection Program

If your account balance falls below zero, you may be eligible for the Negative Balance Protection Program. Where the programme is applied, NTW Markets covers the shortfall and you owe us nothing.

Every case is considered on a case-by-case basis. The programme is not automatic, it is not a feature of your account, and it is not a guarantee that any future shortfall will be covered.

When we consider it

We consider the programme where:

  • the account is a live retail trading account held in your own name;
  • the negative balance arose from market movement on positions that have since closed; and
  • the shortfall is not the result of conduct described under What we do not cover below.

Demo accounts, managed and pooled accounts (including PAMM and MAM), partner and introducing-broker accounts, and accounts operated on behalf of another person are not eligible.

How we decide

Each case is reviewed individually. In reaching a decision we consider, among other things:

  • whether the account has previously been covered by the Negative Balance Protection programme;
  • the size of the shortfall relative to the funds you have deposited;
  • the trading activity that led to the shortfall; and
  • whether the account has complied with these terms and our general Terms of Business, including any bonus or promotion terms.

We may ask you for further information before deciding. We aim to complete reviews promptly and will tell you the outcome.

What we do not cover

The Negative Balance Protection Program is intended for genuine market conditions. We will not normally cover a shortfall that arises from, or in connection with:

  • trading intended to exploit the protection itself, including deliberately taking positions the account could not support;
  • holding opposing positions across two or more accounts, whether held by you or by others acting with you;
  • automated trading, high-frequency trading, latency or price-feed arbitrage, or trading against manifestly erroneous prices;
  • any breach of our Terms of Business, bonus terms, or applicable law.

Where a shortfall is not covered, the negative balance remains on the account and we will contact you to discuss it.

Our discretion

Applying the programme in one case does not oblige us to apply it in another, and does not create any right, expectation or course of dealing. We may change, suspend or withdraw the Negative Balance Protection Program at any time. Where we do, the change applies to shortfalls arising after that point.
